GENERAL TERMS AND CONDITIONS

  1. Overview
  • Kusudi La Adventures is a non-profit that raise funds for good.
  • We offer adventures, hiking and sell merchandise to raise funds for our beneficiaries.
  • We appoint third parties to lead our Kilimanjaro, Morocco and other primary adventures.
  • We coordinate hikes for members of our hiking club in South Africa.
  • You agree to participate in all of our activities at your own risk.
  • We collect personal information directly from you when you join our hiking club, sign up for our newsletters, purchase our merchandise or visit our website. Please consult our Privacy Policy
  • We take and post images and videos of our activities on social media to promote our organisation. We will not use your name or tag you without your consent. 

 

  1. Defined Terms
  • “You” means you the user of this website or participant in our activities.
  • “Kusudi La” means Kusudi La NPC, a non-profit company registered in South Africa.
  • “Hiking Club” means the members who pay a nominal annual fee to receive information about and join the hikes coordinated by Kusudi La, primarily in and around Gauteng.

 

  1. Hiking Activities
  • You must be 18 years or older or have the consent of your parent or legal guardian to participate in our activities.
  • Each person (or their parent or legal guardian for persons under the age of 18):
  • acknowledges that mountain climbing and hiking carry risk of injury or, in extreme circumstances, death;
  • confirms that they are physically fit and healthy to engage in Kusudi La organised activities;
  • acknowledges that drivers and passengers travel to Kusudi La activities, alone or carpooling with others, at their own risk;
  • undertakes to release and indemnify Kusudi La, its directors, officers, agents or representatives from any claims for injury, loss or damage to their person, or property, howsoever arising, and whether or not due to negligence, arising in connection with Kusudi La‘s activities.

 

  1. Personal Information
  • We collect, process and hold personal information from hiking participants as follows:
  • medical and emergency contact information;
  • your email address and mobile number.
  • We will delete medical and emergency contact information when you cease to be a member of our Hiking Club (exception: we will keep release and indemnity forms for 3 years from the date you cease to be a member or 3 years from the date you joined one of our activities as a non-member).
  • We collect, process and hold information when you purchase merchandise from us or visit our website.

  1. Sales of Merchandise
  • All prices exclude transport and shipping.
  • Shipping only available in South Africa.
  • All merchandise is final sale; no returns or exchanges unless there is a material defect.

 

  1. Access to Information
  • You have a right to access information that relates to you.
  • Kusudi La keeps the following types of records: general business records including statutory records, contracts, releases and indemnities, invoices, accounts; personal information relating to members of our Hiking Club (see 4 above); database with details of past and current climbers and donors; promotional and marketing materials; internal and external email communications relating to our day-to-day activities.
